1. About these terms
These Terms and Conditions apply to your access
to and use of the Arqtec I.A. website at
heronaiapp.com (the Site). The
Site is operated by Arqtec Brasil
(we, us,
our). By using the Site, you
agree to these Terms. If you do not agree, you
must not use the Site.
2. The Site is a work of fiction
The Site is a promotional showcase and portfolio
piece created by Arqtec Brasil. Arqtec I.A. is not a
real company and no Arqtec I.A. product exists.
Nothing on the Site is an offer to sell goods or
services, and no product, price, feature,
statistic, testimonial or claim shown on the
Site should be relied on as factual. All content
is provided for creative, satirical and
informational purposes only.
Where we do offer real Arqtec Brasil services, those
are provided under a separate written agreement,
not under these Terms.
3. Changes to the Site and these
Terms
We may update the Site and these Terms from time
to time. Changes take effect when posted on the
Site. Your continued use of the Site after
changes are posted means you accept the updated
Terms.
4. Acceptable use
You must not misuse the Site or interfere with
its normal operation. In particular, you must
not:

attempt to gain unauthorised access to any
part of the Site, its servers, or related
systems;

probe, scan, or test the vulnerability of the
Site or any system or network connected to it;

interfere with or disrupt the security or
operation of the Site, or bypass any measures
we use to restrict access;

introduce viruses, malware, or other harmful
code, or attempt to attack the Site (including
by denial of service attack);

use automated means to access the Site in a
way that places an unreasonable or
disproportionate load on it.
5. Intellectual property
All content on the Site, including text, copy,
design, layout, graphics, animations, video,
audio, and underlying code, is owned by Arqtec Brasil
or licensed to us, and is protected by
Australian and international intellectual
property laws.
You may view and use the Site for personal,
non-commercial purposes only. You must not copy,
reproduce, modify, distribute, publish, sell, or
create derivative works from the Site or its
content without our prior written permission.
6. Downloads and assets
If the Site offers downloadable assets (for
example 3D files or documents), those assets are
provided subject to the licence terms shown on
the download page or included within the files.
If no licence terms are provided, you receive a
limited, non-exclusive, non-transferable,
revocable licence to use the assets for
personal, non-commercial purposes only. You must
not resell, relicense, or redistribute the
assets.
7. Third party links and services
The Site may include links to third party
websites or services. We do not control those
sites and are not responsible for their content,
policies, or practices. Accessing third party
links is at your own risk.
8. Trade marks
All third party trade marks, service marks,
trade names, product names, and logos appearing
on the Site are the property of their respective
owners. Any reference to a third party product
or service is for identification, commentary and
informational purposes only, and does not imply
any affiliation, sponsorship, endorsement or
association between Arqtec Brasil and that third
party.
9. No warranties
The Site is provided on an "as is" and "as
available" basis. To the maximum extent
permitted by law, we make no warranties or
representations, express or implied, about the
Site, including its accuracy, completeness,
availability, or fitness for a particular
purpose. We do not guarantee that the Site will
be uninterrupted, error free, or free from
viruses or other harmful components.
10. Australian Consumer Law
Nothing in these Terms excludes, restricts or
modifies any guarantee, right or remedy you have
under the Australian Consumer Law (Schedule 2 to
the
Competition and Consumer Act 2010
(Cth)) or any other law that cannot lawfully be
excluded, restricted or modified.
Where our liability under the Australian
Consumer Law may be limited, our liability is
limited, at our option, to resupplying the
relevant services or paying the cost of having
them resupplied.
11. Limitation of liability
Nothing in these Terms limits or excludes
liability for death or personal injury caused by
our negligence, for fraud or fraudulent
misrepresentation, or for any liability that
cannot be limited or excluded under applicable
law, including under clause 10.
Subject to the above, and to the maximum extent
permitted by law, Arqtec Brasil will not be liable
for any loss or damage arising from or in
connection with your use of, or inability to
use, the Site, including any indirect or
consequential loss, loss of profits, loss of
revenue, loss of business, loss of goodwill, or
loss of data.
12. Privacy
If we collect personal information through the
Site (for example via a contact form or mailing
list), we handle it in accordance with our
Privacy Policy and the
Privacy Act 1988 (Cth).
13. Governing law and jurisdiction
These Terms are governed by the laws of New
South Wales, Australia. You and we submit to the
non-exclusive jurisdiction of the courts of New
South Wales and the courts able to hear appeals
from them.
